WEST TAMAR COUNCIL RESIDENTS' OPINION SURVEY PRIZE DRAW

TERMS AND CONDITIONS

The West Tamar Council Residents' Opinion Survey is being conducted by the West Tamar Council. By completing the survey you have acknowledged acceptance of these Terms and Conditions. The West Tamar Council Residents' Opinion Survey is open to any individual over the age of 18 residing within the West Tamar municipal boundary. Any information gathered by West Tamar Council during the survey will be dealt with in accordance with the Information Privacy Principles under the Privacy and Data Protection Act. West Tamar Council reserves the right to reject any completed survey that is not consistent with the full list of Terms and Conditions found here. Personal information provided will only be used by the West Tamar Council to conduct the competition.

Winners names may be published in the Beacon and on the West Tamar Council website and social media accounts.

Definitions

  1. The 'Promoter' is West Tamar Council (ABN 21 731 249 084).

  2. 'Survey' means the West Tamar Council Residents' Opinion Survey conducted by West Tamar Council (ABN 21 731 249 084), Eden Street, Riverside 7250.

  3. 'Respondent' means the party entering into this Agreement by responding to the West Tamar Council Residents' Opinion Survey.

  4. 'Competition' means the opportunity for respondents to win in the West Tamar Council Residents' Opinion Survey Draw.

  5. ‘Promotion’ means both the Survey and Competition.

    General

  6. Information on how to enter forms part of the Terms and Conditions of entry. Completion of the Survey is deemed acceptance of these Terms and Conditions.

  7. Failure by the Promoter to enforce any of its rights under these Terms and Conditions at any stage does not constitute a waiver of those rights.

    Eligibility

  8. Entry is open to residents of West Tamar Municipality (this excludes West Tamar Council Councillors or Managers and their spouses).

  9. The competition is open to all residents over the age of 18.

  10. Respondents must live within the West Tamar municipality.

  11. The Promoter reserves the right, at any time, to verify the validity of completed surveys and details concerning respondents and to disqualify any respondent who submits a Survey that is not in accordance with these Terms and Conditions or who is believed to have tampered with the Survey or Competition process.

  12. The Survey commences at 09:00am Australian Eastern Standard Time (AEST) on 28 February 2020 and closes at 4:00pm (AEST) on 27 March 2020 (Promotion Period). Only Surveys that are received in accordance with these Terms and Conditions during the Promotion Period will be eligible for entry.

    Competition Entry

  13. To enter, Eligible Respondents must, during the Promotion Period, complete the survey and complete their personal details using a West Tamar Council Residents' Opinion Survey form (provided in the Beacon, via the West Tamar Council website or by directly requesting through the Council).

  14. Entry into the competition is voluntary. Respondents are able to solely complete the Survey and choose not to enter the Competition.

  15. Each Respondent may only enter a single Survey and single entry into the Competition.

  16. To be eligible for the Competition, Respondents must complete their full name, phone number and address. Respondents may only submit one Survey and one entry into the Competition.

  17. Respondents can only enter the Competition in their own name.

  18. It is the Respondents responsibility to make sure that they adhere to the Terms and Conditions and directions provided when entering. The Promoter will take no responsibility for any Surveys or Competition entries that have been incorrectly completed.

  19. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to a) disqualify any respondent or b) to modify, suspend, terminate or cancel the promotion, as appropriate.

  20. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including but not limited to, where arising out of the following;

    a) any technical difficulties or equipment malfunctions (whether or not under the Promoter's control),

    b) any theft, unauthorised access or third party interference,

    c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter,

    d) any variation in prize value to that stated in these Terms and Conditions;

    e) any tax liability incurred by a winner or entrant or

    f) use of a prize.

  21. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, engages in unlawful or improper conduct which jeopardises or is likely to jeopardise the fair and proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win and will render all entries submitted by that individual invalid.

  22. Any individual found completing multiple surveys, will be disqualified and will result in the disqualification of the associated entries.

    Privacy

  23. Any information gathered by West Tamar Council during the survey will be dealt with in accordance with the Information Privacy Principles under the Privacy and Data Protection Act. West Tamar Council reserves the right to reject any completed survey that is not consistent with the full list of Terms and Conditions found here.

  24. Names and contact information/details will only be used to comply with the terms and condition of this Survey competition. Opinions collected via the surveys will be used by West Tamar Council extensively as a management tool. Personal information provided will only be used by the West Tamar Council. Winners names may be published on the Promoter's website and in the Beacon newsletter.

    Competition Draw

  26. The winners of the West Tamar Council Residents' Opinion Survey Draw will be selected on Friday 3 April 2020 and announced at West Tamar Council Chambers, Eden Street, Riverside 7250.

  27. All winners, will be notified by phone or mail by Wednesday 8 April 2020 and their names may be published on the Promoter's website and in media and public relations material (subject to approval).

    Prizes

  28. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person, unless agreed to by the Promoter.

  29. If any prize (or part of any prize) is unavailable, the Promoter, in its sole discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

  30. The Promoter reserves the right to forfeit prize/s in the event that the Respondent is unable to satisfy these promotion terms and conditions or does not claim a prize. For any prize that remains unclaimed on 24 April 2020 they will become void. No further winners will be announced.

    West Tamar Council Residents' Opinion Survey Prize Draw: (Total prize pool value between $900 and $1260)

    Winning Respondents will be able to choose one of the following prizes:

  • $300 credit towards the Respondents rates notice issued by the West Tamar Council

  • Riverside Swim Centre 20/21 Family Seasons Pass (valued at $420). 

Three Respondents will be drawn at random.
