Draft Local Provisions Schedule

The Public Exhibition period ended on 30 April 2021.  The below information is provided for your information while Council and the Tasmanian Planning Commission consider the representations received and determine what changes will be made prior to adoption of the draft Local Provisions Schedule.  Council will provide further updates when available.


Tasmanian Planning Scheme

The Tasmanian Planning Scheme is made up of two components:

  1. The State Planning Provisions
  2. The Local Provisions Schedule.

The intent of the Tasmanian Planning Scheme is to achieve as much consistency as possible in the planning rules that apply across the State.

West Tamar Draft Local Provisions Schedule

The West Tamar draft Local Provisions Schedule (draft LPS) relates to our specific Council area and allows for planning rules that cater for the unique qualities of the West Tamar.

The draft zone maps are largely a translation from the current Interim Planning Scheme. In considering any zoning conversion or rezoning, the Council is constrained by the guidelines provided by the Tasmanian Planning Commission (TPC).  You can view a copy of Guideline No. 1 – Local Provisions Schedules (LPS): zone and code application here.

The West Tamar draft LPS is made up of:

  • The zone and code maps;

  • The written West Tamar draft LPS, including

    • Specific Area Plans (SAP’s)

    • Site Specific Qualifications

    • Code overlay maps (prescribed and local data)

    • Code lists

State Planning Provisions 

The State Planning Provisions (SPPs) have been approved by the Minister for Planning. You can view the provisions at the planning reform website.

The SPPs have no effect until the draft West Tamar Local Provisions Schedule (draft LPS) commences.

The SPPs set out the way the Tasmanian planning scheme operates, the zones that can be applied to land and the planning rules for use and development that occurs within those zones. The SPP’s also include planning rules in codes, relating to matters that occur across various zones.

Note that representations about the State Planning Provisions cannot be accepted by Council as these are state mandated provisions developed by the Tasmanian Government.

Transitional Provisions 

The West Tamar draft LPS includes some specific area plans, site specific qualifications and code applying provisions that are currently operating in the West Tamar Interim Planning Scheme 2013. These provisions have been approved by the Minister for Planning to transition into the West Tamar draft LPS under Schedule 6 of the 'Land Use Planning and Approvals Act 1993'.

Priority vegetation areas are shown on the Natural Assets Code overlay maps

Priority vegetation areas have been identified in accordance with the data and methodology for priority vegetation areas prepared for the region as part of the Regional Ecosystem Model and Priority Vegetation Layers (the Model) by Natural Resource Planning Pty Ltd, February 2018.

The priority vegetation area shown on the overlay maps differs from the raw data generated by the Model in accordance with the Local Provisions Schedule requirements.  To access the priority vegetation area identified in the raw data, click here to access the online mapping tool.  For details on the raw data, click the blue ‘Priority Veg Report’ button in the panel on the left of the screen.
